
Refund Policy
Refund, Cancellation, and Replacement Policy
This policy governs refunds, cancellations, replacements, and remedies for all products and services
offered by Nibiaa, including SaaS subscriptions, billable hours services, and hardware devices sold
through Nibiaa’s authorized channels.
1. General Policy Statement
Nibiaa operates a non-refundable commercial model. As a standard business practice:
a. Cash refunds are not provided for any products or services once purchased, activated, or
delivered.
b. Remedies, where applicable, are limited to service credits, corrective actions, replacement,
or contract termination, at Nibiaa’s discretion and in accordance with the applicable
agreement.
2. SaaS Subscriptions (Per-Device / Platform Services)
2.1 No Refunds
Subscription fees (monthly, annual, or contract-based) are non-refundable, including:
a. Partial usage period.
b. Unused time
c. Downgrades or early termination by the customer
2.2 Activation & Usage
Once a subscription is activated or a device is provisioned on the platform, the service is
considered delivered and consumed.
2.3 Billing Errors
In the event of a verifiable billing or invoicing error, Nibiaa may:
a. Correct the invoice, or
b. Issue a service credit applicable to future billing cycles
No cash refunds will be issued for billing corrections.
2.4 Service Availability
Service interruptions or performance issues are governed by the applicable Service Level
Agreement (SLA), where remedies may include service credits only.
3. Billable Hours & Enterprise Services
3.1 Non-Refundable Services
All professional services, consulting, integrations, deployments, and enterprise work billed on
a time-and-materials or milestone basis are strictly non-refundable.
3.2 Work Delivery
Once services are rendered, hours are logged, or deliverables are shared, they are deemed
accepted unless disputed within the agreed review window.
3.3 Dispute Resolution
Any disputes related to scope or quality will be addressed through:
a. Clarification
b. Reasonable corrective work
Refunds will not be issued under any circumstances for billable hours already delivered.
4. Hardware Devices Purchased Through Nibiaa
4.1 No Returns or Refunds
Hardware devices purchased via Nibiaa or its authorized partners are non-returnable and
non-refundable once delivered or deployed.
4.2 Replacement Warranty
a. Devices are covered by a mandatory one (1) year replacement warranty for manufacturing
defects only.
b. Replacement is the sole and exclusive remedy.
4.3 Warranty Exclusions
The replacement warranty does not cover:
a. Physical damage
b. Improper installation
c. Misuse or negligence
d. Unauthorized modification
e. Third-party repairs
f. Environmental or electrical damage
5. Contract Termination
a. Customers may terminate subscriptions or enterprise contracts as per the agreed contractual
notice period.
b. Termination does not entitle the customer to:
- Refunds of prepaid fees
- Credits for unused periods, unless explicitly stated in the contract
6. Exceptions & Legal Compliance
Nibiaa reserves the right to make limited exceptions only in cases of:
a. Proven non-delivery of services
b. Material breach by Nibiaa
c. Legal or regulatory requirements
Any such exception:
a. Will not be treated as precedent
b. Will be handled on a case-by-case basis
c. Will prioritize service credits or corrective action, not cash refunds
7. Policy Updates
Nibiaa reserves the right to amend or update this policy at any time.
The latest version will always be available through official Nibiaa channels.
